It is understood that DRIPPED (i.e. the product photography company) is the exclusive, official creator retained to perform the service of making CONTENT (i.e. photographs, videos, infographics, copy, or any other products created and/or services provided by DRIPPED) requested on this contract with CLIENT (i.e. purchaser of CONTENT). CLIENT will receive CONTENT via digital download gallery and will receive digital usage rights associated with received CONTENT. CLIENT is allowed to use CONTENT for the purpose of promoting their product, whether it’s on Amazon, other e-commerce sites, their own site, or social media. CLIENT is not allowed to sell CONTENT for any promotional purposes to anyone else or make monetary gain from the sale of CONTENT. CLIENT is responsible for making a backup of all CONTENT from the digital download. DRIPPED will make every attempt to keep archival copies of CONTENT, but does not guarantee that CONTENT will be retained indefinitely. Original files (e.g. RAW photographic files, PSD files, or any other form of unfinished or source material that leads to the creation of CONTENT) are not included in any deliverables for CLIENT. Only edited and finished complete CONTENT is provided for CLIENT. Regarding photographic imagery, DRIPPED retains the right to edit the photographs and omit any image. It is understood that DRIPPED will not deliver every exposure taken. It is understood that DRIPPED won’t provide multiple versions of the same photo. CLIENT agrees to abide by DRIPPED’s editing decisions, unless otherwise agreed upon after delivery. In terms of communication, CLIENT has one optional phone consultation with DRIPPED per package. CLIENT shall assist and cooperate with DRIPPED in obtaining desired CONTENT. If CLIENT needs something specific, then CLIENT is obligated to communicate this to DRIPPED. DRIPPED shall not be responsible for photographs not taken or CONTENT different from CLIENT’s desires as a result of CLIENT’s failure to provide reasonable assistance, cooperation, or product information. DRIPPED is not responsible for or obligated to provide any revisions of CONTENT or reshoots concerning details not specifically communicated by CLIENT at the time of checkout or during the optional pre-shoot phone consultation. DRIPPED is not obligated to fulfill such requests by CLIENT made after delivery. This includes but is not limited to: general aesthetic preferences, posing, lighting, colors, locations, props used, models, or any specific requests not explicitly communicated by CLIENT at checkout or pre-shoot. If there are such requests concerning CONTENT, and if DRIPPED does agree to accommodate CLIENT’s request by creating new forms of CONTENT in line with CLIENT’s new requests, then CLIENT will be charged for each additional bit of CONTENT at standard pricing. DRIPPED is also not responsible for matching CLIENT's exact shotlist. Occasionally, there are situations in the field that require some alterations of the shotlist (e.g. a complication with models, locations, props, timelines, etc.), or sometimes another version or different set of images better suits CLIENT's needs then what CLIENT originally imagined. DRIPPED's expertise in this matter is after all why DRIPPED was hired, and CLIENT agrees to trust DRIPPED accordingly. DRIPPED is under no obligation to contact CLIENT before executing any such changes to the shotlist, as most decisions of this nature need to be made quickly in the field. All of that said, DRIPPED will try, within reason, to meet the requests of CLIENT's shotlist should CLIENT have any. The charges for this service are based on DRIPPED’s price list. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time the order is placed. DRIPPED is responsible for reasonable and common props and environments. If CLIENT requests specific props that require a specific purchase (e.g. a competitor’s product), then CLIENT is responsible for these costs. CLIENT will not be charged without CLIENT’s permission for any props first. DRIPPED is understood to be the authority with respect to providing CONTENT. DRIPPED is not responsible for reshooting CONTENT nor is DRIPPED to be held accountable to fulfill refunds for photography services. All efforts will be made on the part of DRIPPED to fulfill the desires of CLIENT with respect to the model. All efforts will be made on the part of DRIPPED to match contracted model with CLIENT’s demographic and needs. DRIPPED is not liable to reshoot nor refund CONTENT with respect to fulfilling model details such as/including, but not limited to — model eye color, model hair color, body shape, race, model clothing color, etc. All efforts will be made on the part of DRIPPED to fulfill the desires of CLIENT with respect to lifestyle CONTENT. All efforts will be made on the part of DRIPPED to match lifestyle CONTENT with CLIENT’s demographic and needs. DRIPPED is not liable to reshoot nor refund CONTENT with respect to fulfilling scenery details such as/including, but not limited to — background location of lifestyle photos, background color of lifestyle photos, etc. All efforts will be made by DRIPPED to fulfill this service within a reasonable time frame from when CLIENT’s product arrives in the studio and a plan is agreed upon. It is important to note that these 2 above conditions must be met before any timeline begins. This might be 10 business days, 30 business days, or even much longer depending on factors on the ground. DRIPPED will make an effort to communicate roughly how long the timeline will be, if asked. That said, the communicated timeline is optimal, but not guaranteed, as the date of completed CONTENT is subject to occasional delays based on DRIPPED’s demand, scheduling conflicts with locations or models, and/or additional requests from CLIENT. Additional requests from CLIENT, after the timeline has begun, restart the timeline. If CLIENT requests a shot list from DRIPPED prior to creating CONTENT, and DRIPPED agrees to it, then the timeline starts after the shot list has been confirmed by CLIENT. If DRIPPED decides to give a revision, addition, edit, etc. after the completion of a project (which DRIPPED is not obligated to do), a completely new timeline is started that is outside of the scope of the original timeline for the project. Any CLIENT-provided shot list is to be used as solely a guideline to be referred to by DRIPPED. DRIPPED is not obligated to fulfill any shot list nor is DRIPPED bound by shot list requests in order to fulfill services to create CONTENT. DRIPPED is not liable to reshoot nor refund CONTENT with respect to fulfilling a shot list. DRIPPED does not provide sample shots or any sort of visual presentation before the creation of CONTENT. CLIENT agrees to provide DRIPPED with a new and unused product. CLIENT is required to ensure the product and packaging arrive unused and undamaged. Prior to purchasing CONTENT from DRIPPED, CLIENT is responsible for reading, understanding, and agreeing to all the terms of service provided here in these terms.
